Managing radiation risks

The Protection from Harmful Radiation Regulation supports the Protection from Harmful Radiation Act 1990, which provides the legal framework in NSW for managing radioactive substances and equipment to ensure that radiation is used, stored, transported and disposed of safely.

The Environment Protection Authority (EPA) proposes to remake the current regulation with changes in line with requirements to periodically review NSW regulations. The proposed changes aim to strengthen radiation safety obligations, better align provisions with international and national best practice, and enhance risk-based control measures to improve radiation practices.

We are consulting with radiation licensees and accredited persons, key stakeholders and the community to gain a broader understanding on improving the regulation for radiation protection to ensure it effectively protects people and the environment from the harmful effects of radiation, while enabling safe and beneficial uses.

You should review the proposed Regulation together with the Regulatory Impact Statement (RIS) we have prepared that describes the aims and reasons for the proposed changes and assesses their costs and benefits.

Improving radiation protection laws

We are seeking feedback on the proposed changes to the regulations for radiation protection. Have a read and tell us what you think.

The proposed Regulation makes various changes including:

  • Clarifying and updating licensing exemptions for certain radiation users and lower risk practices and under what conditions they apply
  • Strengthening workplace radiation safety protections and practices, including requirements for radiation management plans and improved radiation incident reporting
  • Clarifying protections for occupationally exposed persons and members of the public
  • A clearer and more enforceable ban on commercial UV tanning services
  • Fees adjustments and how fee increases are calculated
  • Increased penalties for offences.
